Yacht Charters Unlimited (also referred to as “we,” “us,” or “our”) operates this Website as a platform to promote luxury private yacht and catamaran charters and to facilitate inquiries from potential clients to yacht owners and operators.

Important: We are not a party to any charter agreement. We act solely as an intermediary to connect you with third-party yacht owners, operators, or providers (“Providers”). Any booking, charter, or service is arranged directly between you and the Provider. We do not own, operate, charter, or control any yachts, and we are not responsible for the performance, safety, quality, or legality of any charter services.

By accessing, browsing, or using the Website (including submitting any inquiry or contact form), you agree to be bound by these Terms. If you do not agree, please do not use the Website.

1. Description of Services

Yacht Charters Unlimited provides an online platform featuring information about luxury yacht and catamaran charters in destinations including the Caribbean (e.g., Jamaica, Puerto Rico, Dominica, Turks and Caicos), the Bahamas, the Virgin Islands, Belize, Florida coasts, and select U.S. East Coast locations. You may view yacht listings, pricing estimates, descriptions of activities (such as snorkeling, diving, water sports, and onboard experiences), and submit inquiries via our contact form or by calling (954) 469-5284.

All actual charters, payments, contracts, cancellations, refunds, and liabilities are handled directly by the Provider. We do not process payments, guarantee availability, or enter into binding agreements on behalf of Providers.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms. By using the Website, you represent and warrant that you meet these requirements.

3. User Conduct

You agree to use the Website only for lawful purposes and in accordance with these Terms. You must not:

  • Submit false, misleading, or inaccurate information in inquiries.
  • Use the Website to harass, threaten, or harm others.
  • Attempt to interfere with the Website’s operation (e.g., hacking, viruses, or excessive automated requests).

Any resulting charter is governed by the Provider’s own terms, conditions, cancellation policies, and agreements (which may include MYBA-standard terms or similar for larger yachts).

We make no representations or warranties about:

  • Yacht availability, condition, safety, or suitability.
  • Accuracy of pricing, descriptions, or photos (which are provided by Providers).
  • Provider performance or compliance with laws.

You are solely responsible for verifying all details directly with the Provider before proceeding.

5. Payments and Fees

We do not collect or process payments through the Website. Any deposits, balances, or fees (including APA/advance provisioning allowance, fuel, docking, taxes, or extras) are handled directly with the Provider. We are not responsible for payment disputes, refunds, or chargebacks.

6. Cancellations, Refunds, and Changes

Cancellation, refund, or change policies are determined solely by the Provider and any charter contract you sign with them. We may provide general guidance (e.g., weather-related rescheduling possibilities), but we are not liable for any losses, fees, or denied refunds.

We strongly recommend purchasing comprehensive travel insurance that covers trip cancellation, medical emergencies, and maritime risks.

7. Disclaimers and Limitation of Liability

THE WEBSITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW:

Charter activities involve inherent risks (e.g., weather, water-based activities, travel to remote areas). You assume all such risks.

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Website shall be resolved exclusively in the state or federal courts located in Orlando, Florida. You agree to submit to the personal jurisdiction of such courts.
